Terms of Service

Please read carefully. Section 13 contains a binding arbitration agreement and a class-action waiver that affect your legal rights. You may opt out of arbitration within 30 days of first accepting these terms — see Section 13.6.
1. The service
Scentori ("Scentori," "we," "us") is a personal fragrance journal. You sign in to keep a private shelf of fragrances you own or want, write notes, and optionally share parts of your shelf with the community.
2. Eligibility & your account
You must be at least 13 years old to use Scentori. If you live in the European Economic Area, United Kingdom, or another jurisdiction with a higher digital-consent age, you must be at least 16 years old. By creating an account you confirm you meet this age requirement.
You are responsible for keeping your sign-in credentials safe and for everything that happens under your account. Notify us immediately at Scentori.info@gmail.com if you suspect unauthorized access.
3. Your content
You keep ownership of the photos, notes, and reviews you upload. By posting them you grant Scentori a non-exclusive, worldwide, royalty-free license to host, display, reproduce, and back them up so we can run and improve the service. You can delete your content at any time, which terminates this license except for backups we retain for a reasonable period.
You represent and warrant that you own or have the right to use anything you upload — including bottle photos. Do not upload photos you scraped from another website, a retailer, or another user without permission.
4. Fragrance names, brands & trademarks
Fragrance house names, perfume names, and bottle designs (e.g. "Baccarat Rouge 540", "Chanel No. 5", "Dior Sauvage") are trademarks, trade dress, and/or copyrights of their respective owners. Scentori uses these names solely as nominative fair use — the minimum necessary to identify the actual products users discuss and catalog.
Scentori is an independent service and is not affiliated with, endorsed by, sponsored by, certified by, or associated with any fragrance house, perfumer, retailer, or rights holder. Any reference to a brand on Scentori is for identification and discussion only. Rights holders who believe a specific use exceeds nominative fair use should contact us at Scentori.info@gmail.com or follow our DMCA / IP policy.
5. User-generated content & Section 230
Scentori is a provider of an interactive computer service under 47 U.S.C. § 230. Reviews, notes, photos, shelves, and other content posted by users represent the views of those users only and are not endorsed by, adopted by, or attributable to Scentori. We do not pre-screen user content. We may, but are not required to, review, remove, or restrict any user content at our discretion.
If you believe user content violates these Terms or your rights, please report it in-app or email Scentori.info@gmail.com. Copyright complaints follow our DMCA Policy.
6. Acceptable use
You may not:
- Upload content that infringes someone else's copyright, trademark, or privacy.
- Impersonate another person, fragrance brand, perfumer, or retailer.
- Post hateful, harassing, threatening, sexually explicit, or illegal content.
- Scrape, resell, republish, or build derivative datasets from other users' shelves, reviews, or images.
- Use Scentori to sell counterfeits, fakes, or unauthorized decants.
- Interfere with, overload, or attempt to gain unauthorized access to the service.
- Use automated systems (bots, scrapers, crawlers) without our written permission.
7. AI features
Some features (occasion ranking, scent of the day, similar picks, chatbot) are produced by AI models. Outputs are suggestions, not professional advice. Do not rely on them for purchasing, medical, allergy, pregnancy, or safety decisions. We do not warrant that AI output is accurate, complete, or suitable for any purpose.
8. Email & messaging (CAN-SPAM)
We send transactional emails (sign-in, password reset, security alerts, receipts for actions you take). These are part of the service and cannot be unsubscribed from while you have an account.
We send marketing or product-update emails only if you opt in (for example, by joining our waitlist or enabling updates in Settings). Every marketing email includes an unsubscribe link and our physical mailing address, as required by the CAN-SPAM Act of 2003. You can unsubscribe at any time and we will honor the request within 10 business days.
9. Termination
By you. You may delete your account at any time from Settings → Profile. Deletion removes your shelf and personal data as described in the Privacy Policy.
By us. We may suspend or terminate your account, with or without notice, if you violate these Terms, create legal or safety risk for us or other users, or if we discontinue the service. We may also remove specific content for the same reasons.
10. Disclaimers
SCENTORI IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY. WE DO NOT GUARANTEE THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SCENTORI AND ITS OPERATORS, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (a) US $100, OR (b) THE AMOUNT YOU PAID TO SCENTORI IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO THESE LIMITS MAY NOT APPLY TO YOU.
12. Indemnification
You agree to defend, indemnify, and hold harmless Scentori and its operators, contractors, and agents from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your content; (b) your use of the service; (c) your violation of these Terms; or (d) your violation of any third-party right, including any intellectual-property, privacy, or publicity right.
13. Arbitration & class-action waiver (US users)
Please read this section carefully. It affects how disputes are resolved.
13.1 Agreement to arbitrate. Except for the carve-outs in 13.4, you and Scentori agree to resolve any dispute arising out of or relating to these Terms or the service through final, binding individual arbitration, not in court.
13.2 Rules & forum. Arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, available at adr.org. Arbitration will take place in the county where you live, by telephone or video if you prefer, or by document-only submission for claims under $25,000.
13.3 Class-action waiver. You and Scentori agree that each may bring claims against the other only in your or its individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, mass, or representative action. If this waiver is found unenforceable, the entire Section 13 is void.
13.4 Carve-outs. Either party may bring (a) an individual action in small-claims court for claims that qualify, or (b) a claim for injunctive or other equitable relief to stop unauthorized use or infringement of intellectual property.
13.5 Fees. The AAA's rules govern payment of filing and arbitrator fees. Scentori will pay the portion of fees AAA rules assign to us, and may, at its discretion, pay more.
13.6 30-day opt-out. You may opt out of this arbitration agreement by emailing Scentori.info@gmail.com with the subject line "Arbitration Opt-Out" within 30 days of first accepting these Terms. Include your account email. Opting out does not affect any other part of these Terms.
14. Governing law & venue
These Terms are governed by the laws of the State of Illinois, USA, without regard to its conflict-of-laws principles. For any claim not subject to arbitration under Section 13, you and Scentori agree to the exclusive jurisdiction and venue of the state and federal courts located in Cook County, Illinois.
15. Changes
We may update these Terms. If we change something material we'll surface it in the app and update the "Last updated" date. Continued use after changes means you accept the new Terms.
16. Miscellaneous
If any provision of these Terms is found unenforceable, the rest remain in effect. Our failure to enforce a right is not a waiver of that right. You may not assign these Terms; we may assign them to a successor in a merger or acquisition. These Terms are the entire agreement between you and Scentori regarding the service.
